Minors (defined as people who are not yet adults as determined by applicable laws of their country/region of residence) must check these Terms with their legal representative (parental guardian, etc.) and shall only register with the consent of their legal representative, or shall register together with their legal representative.
The definitions for terminology used in these Terms are as follows.
1.1 "Service" refers to the service of the Company provides as the BANDAI NAMCO ID service, which includes the main functions of member authentication, data management, payment, social networks, and information delivery/storage, that can be commonly used across services designated by the Company.
1.2 "Member" refers to an individual who has acquired membership status for this Service in accordance with the procedure determined in Section 5 (Application to Use this Service).
1.3 "Third Party" refers to an individual (including another Member) or legal entity other than the Company or any particular Member.
1.4 "BANDAI NAMCO ID" refers to a unique Member account used in this Service to identify and manage Members.
1.5 "Dedicated Site" refers to the portal site for this Service that the Company operates.
1.6 "Subject Services" refers to those game services, social networking services, information delivery services, product sales services, or any other services (including separate services included therein) provided by the Company or a Third Party designated by the Company that the Company designates as services which are provided through the BANDAI NAMCO ID.
1.8 "BANA Coins" refers to a pre-paid payment method that can be commonly used across services designated by the Company. BANA Coins are granted to a Member, linked to their BANDAI NAMCO ID, based on the amount of coins the Member purchased. BANA Coins are electronically recorded on a server owned or managed by the Company.
1.9 "BANA Points" refers to points that can be commonly used across services designated by the Company. BANA Points are granted free of charge to a Member, linked with their BANDAI NAMCO ID, when the Member fulfills conditions determined separately by the Company. BANA Points are electronically recorded on a server owned or managed by the Company.
1.10 "Data" refers to all information recorded or stored linked to the BANDAI NAMCO ID (including BANA Coins, BANA Points, other virtual currencies issued within the Subject Services, and all contents in this Service and Subject Services (charged or not)).
1.11"Registration Information" refers to, of the Data, the information that can be registered voluntarily and the information that a Member must register about themselves for the registration and management of the BANDAI NAMCO ID.
2. Changes of these Terms
2.1. The Company can make any changes to the contents of these Terms at any time as necessary. Furthermore, the Company shall notify Members in advance regarding the said changes.
2.2. After these Terms are changed, if a Member continues to use this Service, the Company shall assume that the Member has agreed to the changes.
3. Notifications from the Company
Notifications to a Member from the Company shall either be listed on the notification page of the Dedicated Site or be sent by e-mail to the e-mail address the Member registered in order to use this Service.
Inquiries from a Member regarding this Service shall be received by the inquiry
form determined separately by the Company.
5. Application to Use this Service
5.1. A person who wants to use this Service shall apply to use this Service in accordance with the procedure determined separately by the Company, and shall acquire the status of a Member of this Service when the Company approves this application and grants a BANDAI NAMCO ID to the said applicant.
5.2. The Member's BANDAI NAMCO ID is granted exclusively and uniquely to the Member and cannot be transferred, lent, shared, etc.
5.3. If there is a change in the registered information, the Member shall promptly notify the Company of the changed contents using the method determined by the Company.
6. Disapproval of the Application to Use this Service
The Company may decline to approve an application to use this Service if any of the following apply. Furthermore, the Company has no obligation whatsoever to disclose the reason the application was not approved.
(1) The registered information contains falsified information.
(2) The applicant is impersonating someone else.
(3) Multiple applications for the same person.
(4) The applicant's membership status for this Service or qualifications for using Subject Services were revoked in the past.
(5) The Company determines that the applicant is not appropriate for membership for reasons not included in the above.
7. Revocation of Membership Status
7.1. If a Member applies to any of the following, the Company can, without any notification, limit the Member's use of this Service and the Subject Services (deleting Data, temporarily stopping use, etc.) or revoke the Member's membership status for this Service and qualifications to use Subject Services. Furthermore, the Company shall not explain the reason or the circumstances that led to this action.
(1) The Member violated these Terms or the Subject Services Terms.
(2) The Member passes away or loses their legal capacity.
(3) The Company determines that the Member's BANDAI NAMCO ID is being used by a Third Party, regardless of the reason, such as the Member's insufficient management, error in use, transfer, lending, or sharing, etc.
(4) The Member has not used this Service for over one (1) year.
(5) The Company determines a minor did not receive their legal representative's consent.
(6) The Company determines the Member is involved in anti-social activity.
(7) The Company determines that it is inappropriate to grant to the Member membership status for this Service or qualifications to use Subject Services, or determines that the provision of this Service or Subject Services will be impeded if the Member continues to use this Service or Subject Services, for reasons other than those listed above.
7.2. If the Member has their membership status for this Service revoked in accordance with Paragraph 1, the Member cannot use this Service or the Subject Services in any way. Furthermore, once membership status for this Service is revoked, no Data can be recovered.
7.3. The Company shall bear no responsibility regarding any damages incurred by the Member due to the measures taken by the Company based on Paragraph 1.
8. Cancellation of Member Registration
8.1. Members can, at any time, perform the procedure specified by the Company to cancel their membership registration for this Service.
8.2. If a Member cancels their membership registration for this Service in accordance with Paragraph 1, the Member cannot use this Service or the Subject Services whatsoever. Furthermore, once membership registration for this Service is cancelled, no Data can be recovered.
9. Premise of Self-Responsibility
9.1. Members shall, at their own expense and responsibility, solve any disputes, such as complaints, inquiries, or claims for compensation from a Third Party, that occurred related to the Members' own actions in this Service.
9.2. Members shall, at their own expense and responsibility, prepare and maintain the hardware, software, and Internet connection, etc., necessary to use this Service.
9.3. Members shall bear responsibility to manage their BANDAI NAMCO ID (including the password). Members shall be liable for any damages occurring from circumstances such as a Third Party using the Members' BANDAI NAMCO ID, regardless of the reason, such as insufficient management, error in use, transferring, lending, or sharing, and the Company shall bear no responsibility thereto. Furthermore, even in cases where the BANDAI NAMCO ID was used by a Third Party, the Company shall assume that the Members themselves used it.
9.4. The Company shall not be concerned with disputes that occur between a Member and a Third Party.
10. Prohibited Behavior
When using this Service, Members must not perform acts that correspond to the following or acts that have a chance of corresponding to the following. Please refer to this page
for details about prohibited behavior.
(1) Acts which violate the law or acts which are against public order and morals.
(2) Acts which infringe on the rights or profits of the Company or a Third Party.
(3) Acts to post inappropriate expressions or falsified information.
(4) Illicit acts or acts for commercial gain using this Service.
(5) Acts which hinder or slander the provision of this Service.
(6) Acts to analyze, copy, or alter, etc., the contents of this Service.
(7) Acts which harass or are unpleasant to a Third Party.
(8) Acts to use this Service for the purpose of interacting with the opposite sex.
(9) Acts that violate these Terms or the Subject Services Terms.
(10) Acts other than those above that the Company determines inappropriate.
11. Prohibition for Transferring Rights and Duties
Members cannot, without approval from the Company, assign, transfer, pledge, or in any way dispose of any of the rights and duties Members have with respect to the Company.
12. BANA Coins
12.1. Members can purchase BANA Coins using the payment method determined separately by the Company. Refer to the purchasing page for the sale price of BANA Coins.
12.2. Minors require the consent of their legal representative in advance of any purchase of BANA Coins (including use (consumption)).
12.3. The Company can determine an upper limit for purchasing and for possessing BANA Coins.
12.4. BANA Coins are valid for one (1) year, commencing from the date of last use thereof (the last day of your purchase or consumption thereof, whichever comes later). Furthermore, if BANA Coins are granted free of charge, then such BANA Coins granted free of charge shall be used (consumed) prior to the purchased BANA Coins.
12.5. Except in cases determined by law, the Company does not refund BANA Coins in cash or in coupons, etc.
12.6. The Company shall not refund any BANA Coins (shall not accept returns of merchandise) that Members use (consume).
12.7. BANA Coins cannot be transferred to, lent to, or shared with a Third Party.
13. BANA Points
13.1. BANA Points are valid for one (1) year, commencing from the date of last use thereof (the last day you were granted or consumed BANA Points, whichever comes later).
13.2. The Company can, at its discretion, set an upper limit for acquiring and possessing BANA Points.
13.3. The Company shall not refund any BANA Points (shall not accept returns of merchandise) that Members use (consume).
13.4. BANA Points cannot be transferred to, lent to, or shared with a Third Party.
14. Intellectual Property Rights
14.1. The copyrights and all other intellectual property rights related to this Service shall belong to the Company and any Third Party from which the Company has gained approval for use.
14.2. All contents provided to a Member through this Service have been approved by the Company for the Member to use for the Member's private and non-profit use within this Service in accordance with these Terms, and cannot be used for any other purpose.
15.1. Members post information, such as text and images, at their own responsibility.
15.2. The Company can use information posted by Members in this Service free of charge as part of this Service. Also, the Company can use, free of charge, posts related to products introduced in this Service in advertisements and promotions, etc., for this Service and the said products.
15.3. In cases determined below, the Company can, without prior notice, take appropriate measures such as changing or deleting part or all of the information posted by Members in this Service.
(1) The information posted corresponds to an item in Section 10. Prohibited Behavior.
(2) There was a notification/statement from a public agency or the legitimate owner of the right asserting that the posted information is illegal, is a violation of public order and morals, or is an infringement on the rights of another person.
(3) The amount of information is too large and hinders the provision of this Service or the maintenance of servers involved in this Service.
(4) The Company determines that such measures are necessary for reasons other than those listed above.
15.4. Even in situations that correspond to Paragraph 3, the Company shall not confirm the change or deletion before or after the fact, and shall not explain the reason or circumstances that lead to the change or deletion. Furthermore, except in cases determined by law, the Company shall not be obligated to monitor, change, or delete information.
16. Transfer of this Service
The Company can transfer the business related to the provision of this Service to a Third Party without the approval of Members. In such a case, so that Members continue using this Service, the Company can transfer to the said assignee the Company's contractual status related to this Service, the Company's rights, duties, Data, and anything else based on this Service and these Terms. Furthermore, the Company shall notify Members without delay regarding the said transfer.
17. Stoppages of this Service
17.1. In any of the following situations, the Company can stop providing all or part of this Service without notification in advance.
(1) A natural disaster occurred.
(2) A riot, strike, or similar event occurred.
(3) A fire, blackout, or other unforeseeable accident occurred.
(4) Any other emergency situation occurred.
(5) The Company determined it was necessary, such as for emergency maintenance.
17.2. In addition to the items in Paragraph 1, the Company shall bear no responsibility for any damages a Member incurs for reasons out of the Company's control.
18. Changes of this Service
The Company can change the contents of this Service without notifying Members in advance.
19. Termination of this Service
The Company can terminate all or part of the provision of this Service due to the Company's circumstances. Furthermore, the Company shall notify Members in advance regarding the said termination.
20.1. The Company makes no guarantees whatsoever regarding the provided content of this Service, such as its completeness, usefulness, accuracy, reliability, or safety. Also, the Company does not guarantee that this Service will be available or that a Member's Data will be reflected in any environment.
20.2. The Company does not guarantee that this Service is without defects or errors.
20.3. The Company may stop part or all of this Service for reasons such as periodic maintenance. Furthermore, the Company shall notify Members in advance regarding the said stoppage.
20.4. The Company shall bear no responsibility for damages incurred by a Member or a Third Party (including all damages such as the loss of Data or damages to software or hardware) regarding not being able to use all or part of this Service, as well as changes, stoppages, or the termination of this Service, regardless of the reason.
20.5. Notwithstanding Paragraphs 1 through 4, if a defect occurs that interferes with the use of BANA Coins or contents purchased in this Service, the Company shall fix the said defect or provide a replacement.
20.6. Notwithstanding Paragraphs 1 through 4, if a Member incurs damages for reasons imputable to the Company regarding the use of BANA Coins or contents purchased in this Service, the following amount shall be the upper limit for the Company's liability. However, this limit shall not apply for damages caused by the Company's intent or gross negligence.
(1) For BANA Coins:
An amount equivalent to the Coins the Member had at the time the said damages occurred.
(2) For contents purchased in this Service:
An amount equivalent to the contents the Member purchased in this Service during the month in which the said damages occurred.
20.7. The Company shall bear no responsibility for damages incurred by a Member or a Third Party related to Subject Services. In such an event, the Member shall solve the dispute with the provider of the said Subject Service.
21. Governing Laws and Jurisdiction
21.1. This Service and these Terms shall be governed by the laws of Japan and construed in accordance with the laws of Japan.
21.2. If litigation becomes necessary between the Company and a Member regarding this Service and these Terms, the Tokyo District Court shall be the first exclusive competent court.
22. No waiver
If the Company does not exercise its rights based on these Terms and laws and regulations, that does not mean the Company has waived the said rights. The Company remains able to exercise those rights.
In the event that any provision or part of a provision of these Terms is invalidated by laws or regulations, all the other provisions of these Terms other than the invalidated provision or part of the provision shall continue to be valid and shall apply to both the Company and Members.
24.1. Although these Terms have been translated into a language other than Japanese, the said translation is provided for the Members' convenience, and only the Terms written in Japanese shall apply to the contractual relationship between Members and the Company.
24.2. If there is a discrepancy between the terms written in Japanese and the translated terms, the terms written in Japanese shall take precedence.
25. Treatment of Personal Information
, the Company strictly manages the Members' personal information and usage information, such as cookies, usage history, purchasing history, and positional information, acquired through this Service. Furthermore, the Company shall use this information acquired from Members within the scope of the purposes determined in "About Treatment of Personal Information"
26. Special Provisions Concerning Member in the U.S.
26.1. BANDAI NAMCO ID is available for individuals aged 13 years or older.
26.2. If you are a minor (meaning that you are 13 years or older and have not reached adult age as stipulated by applicable law in your country/region of residence), you may continue with the registration process only if you have received permission from your legal representative.
